Welcome to BaseBites (“we”, “us”, “BaseBites”). These Terms & Conditions (“Terms”) govern your use of the BaseBites website (www.base-bites.com) and mobile applications (collectively, the “Services”). By using our Services, you agree to these Terms.

1. ACCEPTANCE OF TERMS

By creating an account or placing an order, you agree to comply with these Terms. If you do not agree, do not use the Services.

2. ELIGIBILITY

You must be at least 18 years old and legally able to enter a binding contract.

3. ACCOUNT REGISTRATION

  • Provide accurate information and update it as necessary.

  • Keep your password and account secure.

  • You are responsible for all activity under your account.

  • We may suspend or terminate accounts for any violation of these Terms.

4. SERVICE DESCRIPTION

BaseBites connects customers with restaurants and delivery partners. We do not prepare food; restaurants are independent operators.

5. ORDERS & PAYMENT

  • Orders are subject to restaurant acceptance.

  • Payment is due at the time of order.

  • Prices and availability may change without notice.

  • Delivery and service fees are displayed at checkout.

  • Delivery Fees:

    • 0.1–5 miles: $13.50

    • 5.1–10 miles: $20.50

    • 10.1–15 miles: $27.50

6. DELIVERY

  • Delivery times are estimates only; delays may occur.

  • Deliveries are facilitated by independent delivery partners.

  • BaseBites is not liable for delays or issues caused by restaurants or delivery partners.

7. CANCELLATION & REFUND POLICY

  • Orders may be canceled within a limited window before preparation begins.

  • Refund eligibility is determined case by case; contact 470‑222‑3130 or www.base-bites.com.

8. USER CONDUCT

You agree not to:

  • Use Services for unlawful purposes.

  • Harass or harm others.

  • Violate local laws or regulations.

9. DISCLAIMER OF WARRANTIES

Services are provided “as is” and “as available.” BaseBites disclaims all warranties, express or implied.

10. LIMITATION OF LIABILITY

BaseBites is not liable for indirect, incidental, or consequential damages. Maximum liability is limited to the amount paid for the relevant order.

11. INDEMNIFICATION

You agree to indemnify BaseBites for claims arising from your use of the Services or violation of these Terms.

12. TERMINATION

We may suspend or terminate your access for violations of these Terms or at our discretion.

13. GOVERNING LAW

These Terms are governed by the laws of the state in which BaseBites operates.
